NOTICE: THIS IS A LEGALLY BINDING DOCUMENT. PLEASE READ CAREFULLY.

The novel coronavirus (COVID-19) has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread through person-to-person contact, airborne particles, and contact with contaminated surfaces. There is currently no guaranteed cure or vaccine, and the virus can cause serious illness, long-term complications, and death.

Julian Woods Athletics, Inc. (“JWA”) cannot prevent you or your child(ren) from becoming exposed to, contracting, or spreading COVID-19 while participating in any of JWA’s programs, practices, games, or events, whether held on JWA property or at other locations. By choosing to participate in JWA activities, you acknowledge and accept this risk.

ASSUMPTION OF RISK

I understand the risks associated with COVID-19 and participation in sports activities, including but not limited to: physical injury, illness, long-term health complications, and death. I voluntarily assume full responsibility for any risk of loss, personal injury, illness (including exposure to or contraction of COVID-19), disability, or death that may result from participation in any activity organized or sponsored by Julian Woods Athletics, Inc.

I understand and acknowledge that sports and physical activities inherently carry certain risks, including but not limited to: sprains, fractures, concussions, permanent disability, or other bodily injuries. I understand that JWA may also record or photograph activities for promotional, training, or media purposes.

 

WAIVER AND RELEASE OF LIABILITY

In consideration of being allowed to participate in any Julian Woods Athletics, Inc. programs or activities, I, on behalf of myself and/or my child(ren), hereby voluntarily and knowingly release, waive, discharge, and covenant not to sue Julian Woods Athletics, Inc., its owners, board members, officers, directors, managers, coaches, trainers, officials, referees, volunteers, employees, sponsors, contractors, agents, and representatives (collectively, “Released Parties”) from any and all liability, claims, demands, causes of action, or damages of any kind, whether known or unknown, in law or equity, arising out of or related to:

• Exposure to or contraction of COVID-19;

• Participation in any sports, athletic training, practices, tournaments, games, or events;

• Use of any equipment or facilities associated with JWA;

• Filming, video recording, photography, and promotional use of image or likeness.

This release includes, but is not limited to, claims of negligence, gross negligence, personal injury, property damage, illness, death, invasion of privacy, or any violation of rights, whether arising from actions or inactions of the Released Parties.

 

PHOTOGRAPHY/FILMING CONSENT

I acknowledge and agree that Julian Woods Athletics, Inc. may capture photographs, video footage, and audio recordings of myself and/or my child(ren) during participation in its programs. I grant JWA permission to use such media for promotional, educational, or informational purposes in print, online, or any other public platform without compensation.

CHOICE OF LAW

​

This waiver and release shall be governed by the laws of the State of Florida, and any legal action arising from this agreement shall be brought exclusively in a court of competent jurisdiction located in Florida.

ACKNOWLEDGEMENT AND SIGNATURE

I HAVE CAREFULLY READ THIS WAIVER AND RELEASE OF LIABILITY. I FULLY UNDERSTAND ITS CONTENTS, AND I AM AWARE THAT THIS IS A RELEASE OF LEGAL RIGHTS. I VOLUNTARILY AGREE TO ITS TERMS.
